1. Introduction to Site Terms & Conditions
This page sets out the terms and conditions on which we supply the goods and services listed on our website at www. audiogo.co.uk. Please read these terms and conditions carefully before ordering any goods or services from AudioGO. You should understand that by ordering any of our goods or services, you agree to be bound by these terms and conditions.
The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly before ordering goods in case there are any changes.

Our US registered office is 42 Whitecap Drive, North Kingstown, Rhode Island, 02852 under company number 042587469.

4. Credit/Debit Card Security
Shopping at AudioGO is safe and guaranteed. All the information that you enter is private and secure. AudioGO places great importance on maintaining the security of the information that you provide and for this reason we use advanced Internet security system to safeguard your data. All the data that you send through, including your name and address, is encrypted and converted into code before it is transmitted across the Internet. Therefore in the extremely unlikely event that the data should be intercepted, it would be encrypted and difficult to decipher.
The checkout service we use will check the authenticity of the credit card details when they are entered.
In the event of unauthorised use of your credit card or debit card most banks and credit card companies either cover the charges that result or may limit your liability to £50.
Do not send credit/debit card details via standard email, as this is not secure, please use the online shop or telephone us to place your order. In the unlikely event of unauthorised card use please be sure to contact your card issuer immediately as per your contractual arrangement with them.
5. How safe are my details when I place an order?
AudioGO places great importance on maintaining the security of the information that you provide and for this reason we use advanced Internet security systems to safeguard your data.
6. Your Status
By placing an order through our site, you warrant that:
(a) you are legally capable of entering into binding contracts;
(b) you are at least 18 years old; and
(c) the information given on your order form is complete and accurate.
7. Our Contract
All orders are subject to acceptance by us and availability of the requested item(s). After placing an order, you will receive an email from us acknowledging that we have received your order. It will state what the item(s) you have ordered are, the cost (including VAT and postage and packaging) and delivery and invoice details. If your order has been unsuccessful, you will be made aware of the reason why and possible explanations. Please note that this acknowledgment email does not mean that your order has been accepted – your order constitutes an offer to us to purchase goods or services. All orders are subject to acceptance by us.
8. Availability and Delivery goods
Where no delivery date is specified for the goods or services then your order will be despatched within 21 days unless there are exceptional circumstances.
9. Risk and Title
The goods will be at your risk from the time of delivery.
Ownership of the goods will only pass to you when we receive full payment of all sums due in respect of the goods, including delivery charges.
10. Price and Payment
AudioGO aims to ensure that the pricing of goods and services on AudioGO is correct at all times. However, the web pages may not always accurately reflect the correct details at the moment at which you place your order. AudioGO reserves the right to change prices without prior notice at any time prior to dispatch.
All GBP prices include VAT but exclude delivery costs, which will be added to the total amount.
All USD prices include the relevant Sales Tax but exclude delivery costs, which will be added to the total amount.
All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and AudioGO will not be liable for any delay or non-delivery.
Goods despatched by AudioGO.co.uk to addresses outside of the European Union are generally not subject to VAT.
If you order goods from Audiogo.co.uk for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
11. Returns and Refunds
Your statutory rights as a consumer are not affected if, for any reason, you wish to return any goods bought from AudioGO.co.uk within thirty days of the date of order (by law, customers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered). This applies to all of our goods except for digital items where the item has been downloaded.
Where you have validly exercised your rights to withdraw from any purchase you will receive a full refund of the price paid for the goods in accordance with our refunds policy.
Please note that we only accept returns for any non-faulty items that are returned in their original condition and which have not been worn/used.
In the case of CD products sold in hard copy form, your right to cancel and return the goods as set out above only applies where such products are unopened and the seal on the goods remains unbroken. We can only accept the return of opened items if they are faulty.
12. Downloads
Digital files, including without limitation download to own films, digital audio and digital music files ("Downloads") will only be made available for you to download once your payment has been authorised. No contract of any kind between you and AudioGO is formed unless and until you make payment for the Downloads.
You may only use the Downloads for personal, non-commercial purposes. Any copying, reproduction, lending or hiring, public performance, broadcasting or any other form of distribution of the Downloads is prohibited and will constitute copyright infringement. You may not cancel any purchase of a Download after your payment has been confirmed and may only return a Download if it is defective. If you are unable to complete the download process or wish us to provide a replacement for a file that is defective please contact our Customer Service team and, where this is due to our default, we will replace or refund the Download.
Once your order for a download is accepted it will be available for you to download over a period of at least 3 months from the date of your purchase.
13. Copyright
All rights, including copyright, in the content of the AudioGO web pages are owned, licensed to or controlled for these purposes by AudioGO. In accessing AudioGO's web pages, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of these AudioGO web pages for any other purpose whatsoever without the prior written permission of AudioGO.
14. Force majeure
AudioGO shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
15. Limitation of Liability
Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction, however nothing in these terms and conditions shall exclude or limit AudioGO’s liability for death or personal injury as a result of AudioGO’s negligence.
We accept no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to any item delivered that is caused by any event or circumstance beyond our reasonable control.

17. Transfer of Rights and Obligations
The contract between you and AudioGO is binding on you and us and on our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.
18. Privacy
We take your privacy very seriously and are registered under the Data Protection Act. AudioGO collects and processes data in accordance with our Privacy Policy. By using AudioGO you consent to such collection and processing and you warrant that all data provided by you is accurate.
19. Waiver
If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default.
20. Entire Agreement
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party´s only remedy shall be for breach of contract as provided in these terms and conditions.
21. Invalidity and Governing Law & Jurisdiction
If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.
Contracts between you and AudioGO shall be governed by English law and you and AudioGO submit to the non-exclusive jurisdiction of the courts of England and Wales.
